TERMS AND CONDITIONS

 

The following terms and conditions apply to the “ULTIMATE VIP ESCAPE” Vacation Package (hereinafter referred to as the “Vacation Package”) and are intended to ensure a clear understanding of the Vacation Package purchase, which incorporates and is subject in all respects to (i) the benefits included herein, (ii) our Comprehensive Privacy Notice, available at www.vidantaworld.com (the “Official Website”), (iii) the resort rules, and (iv) any policies, terms, or conditions available or added in the future on the Official Website, all of which are legally binding. References to the Vacation Package include these terms and conditions, the Privacy Notice, resort rules, and any other policy, terms or conditions added to the Official Website. The individual receiving and booking the Vacation Package is referenced herein as the “Primary Beneficiary.” By acquiring and booking the Vacation Package, the “Primary Beneficiary” acknowledges having read, understood, and accepted its contents and all associated terms and conditions.

 

The benefits included in the Vacation Package are provided, operated, and administered by Rivera Mayan, S.A. de C.V., a company incorporated under the laws of the Mexican Republic, located at Carretera Federal Cancún-Playa del Carmen Km 48, Playa del Carmen, Quintana Roo, Mexico, C.P. 77710 (the “Company”). The Company, through the Vacation Package, will provide the Primary Beneficiary with the benefits described herein under the terms specified below and incorporated herein:

 

To book the Vacation Package, the Primary Beneficiary must reserve accommodations through the website www.cirquedusoleil.com/vacations or by calling the VidantaWorld Customer Care Center at 1-855-227-5685 from the United States or Canada, or 800-718-8409 from within Mexico.

 

Accommodations

 

• Room Type: One-bedroom suite with a maximum capacity of 2 (two) adults and 4 (four) children under 10 (ten) years of age at Jungala Park Hotel, located within the VidantaWorld Riviera Maya development.
• Availability: Reservations are subject to availability and may be used any time of the year except Easter Week, Thanksgiving Week (USA), Christmas Week, and New Year’s Week.
• Occupancy: Under no circumstances may the Primary Beneficiary exceed the maximum room occupancy.

 

Airport-Hotel-Airport Transportation

 

• Included Benefit: The Primary Beneficiary and registered room companions will receive complimentary round-trip ground transportation in a private vehicle from Cancun International Airport to Jungala Park Hotel and back.
• Booking Requirement: Transportation must be requested at least 5 (five) days prior to the scheduled hotel arrival date by calling the VidantaWorld Customer Care Center at 1-855-227-5685 from the United States or Canada, or 800-718-8409 from within Mexico.
• Confirmation: Upon reserving transportation, a confirmation voucher will be issued and sent electronically to the email associated with the Vacation Package purchase, detailing instructions for benefit usage upon arrival.
• Third-Party Service: The transportation service is provided by an independent third party, and additional terms and conditions may apply.

 

Buffet Breakfast

 

• Included Benefit: The Primary Beneficiary and registered room companions will receive a complimentary buffet breakfast for the duration of their stay as part of the Vacation Package.
• Service Details: Available daily and includes service charges.
• Restrictions: Hours and dining venues for benefit redemption may vary by season and at the Company’s discretion. A la carte breakfast options and alcoholic beverages do not qualify for this benefit.

 

Jungala Aqua Experience Park: Admission

 

• Included Benefit: Admission tickets to Jungala Aqua Experience Park for the Primary Beneficiary and registered room companions, to be used during their stay under the Vacation Package.
• Booking Requirement: Tickets may be reserved through the VidantaWorld Customer Care Center prior to arrival or with the Concierge at check-in.
• Restrictions: Once confirmed, tickets are non-cancellable, and the reserved date cannot be modified.
• Additional Terms: Access to Jungala Aqua Experience Park is subject to additional terms and conditions, available at https://www.jungala.com/avisos/en/termsofpurchase.pdf.

 

Jungala Aqua Experience Park: Private Cabana Use

 

• Included Benefit: The Primary Beneficiary will receive a complimentary Premium Experience in a Private Cabana, which must be used during their visit to the park using tickets obtained through the Vacation Package.
• Cabana Service: Includes a private cabana, a pitcher of spa water, a pitcher of flavored water, a fruit platter, popsicles, a selection of 4 items from the special Cabana menu, an Evian facial spray, refreshing face towels, and sunglass cleaning. This benefit is provided as a general service, not per person.
• Capacity: The maximum capacity for this experience is 2 (two) adults and 4 (four) children.
• Availability: Cabanas are subject to availability and may be reserved upon reserving park admission tickets at the Concierge desk or park ticket booth on the day scheduled for the ticket benefit.

 

Cirque du Soleil JOYÀ: VIP Experience

• Included Benefit: The Primary Beneficiary and registered room companions will receive tickets for the VIP Show & Dinner Experience of Cirque du Soleil JOYÀ, to be redeemed during their stay.
• Booking Requirement: Tickets may be reserved through the VidantaWorld Customer Care Center prior to arrival or with the Concierge at check-in.
• Additional Terms: Tickets for access to Cirque du Soleil JOYÀ are subject to additional terms and conditions, available at https://teatrovidanta.com/termsandconditions.

 

Cirque du Soleil JOYÀ: Meet & Greet

 

• Included Benefit: A Meet & Greet experience with an artist of Cirque du Soleil JOYÀ for the Primary Beneficiary and registered room companions, redeemable on the same day as the show.
• Booking Requirement: The Meet & Greet experience must be reserved when confirming show tickets.
• Experience Details: Includes a post-show meeting with a JOYÀ artist, lasting between 5 (five) and 10 (ten) minutes. Specific characters’ presence is not guaranteed, and the number of artists may vary. Availability and details of this experience may change without prior notice.

Cirque du Soleil JOYÀ: Theater Tour - Training

 

• Included Benefit: The Primary Beneficiary and registered room companions will have the opportunity to attend a guided theater tour of Cirque du Soleil, including observing a JOYÀ artist training session.
• Booking Requirement: Tours must be scheduled with the Concierge at hotel check-in.
• Restrictions: Only one tour reservation is allowed per Primary Beneficiary. Tours are scheduled at the theater operator’s discretion and are subject to change or cancellation without prior notice. Limited visitor capacity applies.

 

Welcome Kit

 

• Included Benefit: The Primary Beneficiary will receive a welcome kit in their room as part of their reservation.
• Contents: Includes a beach bag, two thermoses, and two towels. Kit contents are subject to availability and may vary at the Company’s discretion.

 

$100 USD Credit for Cirque du Soleil Dream Escape Store

• Included Benefit: The Primary Beneficiary will receive a credit of USD $100.00 (one hundred US dollars) or its equivalent in local currency, for use at the official Cirque du Soleil Dream Escape store.
• Redemption: Credit will be applied to the store purchase charged to the room, reflected on the account statement at check-out.

 

Welcome Cocktail

 

• Included Benefit: The Primary Beneficiary will receive two complimentary cocktails per reservation and per day of stay.
• Redemption: Cocktails may be redeemed at specialty bars and dining venues. No additional purchase is required.

 

Amenities

 

• Included Benefit: Special amenities, limited to one per room, including (1) margarita welcome kit, (1) sweet amenity, and (1) chocolate amenity.
• Delivery: Amenities will be delivered to the room during the stay.
• Additional Terms: Amenity designs shown on the Official Website are illustrative and may vary at the Company’s discretion based on availability.

 

Benefits are subject to availability upon arrival or during the hotel stay. Any cancellation or modification to the reservation may result in the modification, variation, or even cancellation of one or more benefits.

 

The benefits included in the Vacation Package are for the exclusive use of the Primary Beneficiary and, as indicated above, may in some cases be used in conjunction with registered companions, who must be listed in the same room as the Primary Beneficiary, in accordance with the room’s maximum occupancy and the specific reservation terms. Benefits are non-transferable, non-cumulative with other promotions, and non-redeemable for cash, either in whole or in part. Benefits must be redeemed or used during the period covered by the Vacation Package reservation and may not be applied to additional or future reservations. The Primary Beneficiary accepts and acknowledges that none of the benefits included in the Vacation Package may be used for commercial purposes or transferred to third parties. The value of lodging nights is not redeemable for cash or subject to any refund, even if some or all lodging nights remain unused after being reserved through the Vacation Package; the same applies to all included benefits. Except for food and/or beverages specifically indicated above, lodging does not include food, beverages, or any other products or services beyond the lodging itself. Any and all expenses incurred by the Primary Beneficiary or companions for such services, including any applicable taxes, are the sole responsibility of the Primary Beneficiary and must be settled in full at check-out.

 

Cirque du Soleil, Cirque du Soleil Dream Escape, and Cirque du Soleil JOYÀ are used with authorization from Cirque du Soleil Entertainment Group.

 

Any dispute related in any way to the Vacation Package and/or any included benefit shall be resolved exclusively in accordance with the dispute resolution provisions set forth herein. The Primary Beneficiary, individually and on behalf of any travel companion making use of any accommodations or service provided through the Vacation Package, acknowledges and agrees that any claim, controversy, or dispute related in any way to the Vacation Package or its benefits shall be resolved exclusively and definitively under the Rules of Arbitration of the Arbitration Center of Mexico (CAM) by a single arbitrator of Mexican nationality, unless the Primary Beneficiary and the Company resolve the dispute voluntarily by mutual agreement under the conciliatory procedures of Mexico’s Consumer Protection Agency (PROFECO). The arbitration venue shall be Guadalajara, Jalisco, Mexico, and the applicable law shall be the law of the Republic of Mexico, excluding its conflict of laws provisions. The Primary Beneficiary agrees that the courts of Guadalajara, Jalisco, Mexico shall have exclusive jurisdiction in any action to enforce or vacate the arbitrator’s decision. The Primary Beneficiary expressly waives any right to pursue any claim arising out of or related in any way to the Vacation Package or any benefits against Cirque du Soleil Entertainment Group or any of its affiliate entities. The Primary Beneficiary expressly waives any right to pursue any claim arising out of or related in any way to the Vacation Package or any benefits in any other jurisdiction or venue that might otherwise be claimed due to any present or future domicile or for any other reason. Any arbitration hereunder shall be conducted solely on an individual, non-class basis. By acquiring and/or using the Vacation Package, the Primary Beneficiary and any travel companion of the Primary Beneficiary acknowledge and agree that they understand and accept these terms and conditions.
